359. The commissioners may enact ordinances for the fol-
lowing purposes, to wit: to grade, level and repair sidewalks ;
to construct causeways; to regulate and keep in repair streets,
lanes and alleys; to restrain and prohibit gaming; to provide
for licensing or restraining theatrical or other public exhibitions
or amusements within the town; for the prevention and extin-
guishment of tires, and the purchase and keeping in repair and
preservation, a fire engine and apparatus, and to provide for
the establishment and maintenance of fire and water depart-
ments; to license or tax dogs within the corporate limits of
Middletown, and regulate the keeping of dogs therein, and to
prevent dogs from running at large in the town; to prevent
introduction of contagious diseases; to suppress drunkenness,
vice and immorality; to punish by fines, breaches of the peace,
and preserve the peace, order and" quiet of the town; to assess
the property within said taxable limits, and to levy and collect
taxes tnereon, necessary to carry into effect the ordinances of
the town.

360. They shall cause the footways to be paved and repaired .
at the expense of the owners of lots binding thereon when-
ever they may direct such work to be done, and shall direct
how and of what materials the same shall be paved or re-
paired.

361. If the owner of any house or lot or part of a lot bind-
ing on a street which they may direct to be paved, or repaired,
shall not reside in said town, the tenant or person occupying
same, or who have charge thereof, shall cause such work to be
done, and the money expended by him thereon, in obedience
to the ordinance of the corporation, shall be allowed by such
owner and deducted from the rent due, or to become due, and
if any such owners or tenants shall neglect or refuse so to do,
the Burgess and commissioners shall have such footway paved
and repaired and collect the expense thereof with costs by
distraining or selling such property, or by an action of debt.

362. The Commissioners may appoint, annually, a police-
man, who shall have power to preserve the peace and good
order of the town, and shall serve all civil and criminal pro-
cesses that may be directed to him, and perform such other
duties as may be prescribed by ordinance, and they may, from
time to time, appoint such additional policemen as may be
required for the preservation of order.
