those which appertain to the office of the present clerk of the
commissioners of the tax for said county.
SEC. 6. And be it enacted, That in case of a vacancy occur-
ring in the office of clerk to the commissioners, as created by
this act, in consequence of death, resignation, removal or
disqualification, the same shall be supplied as soon thereafter
as may be practicable, in the manner prescribed and directed
by the preceding section of this act.

Vacancy of clerk.

SEC, 7. And be it enacted, That the said clerk of the com-
missioners to be appointed in virtue of this act as aforesaid, shall
be entitled to receive, as compensation for his services, such
sum annually as the said commissioners may direct, not ex-
ceeding the sum of three hundred dollars, to de levied on the
assessable property of said county, collected and paid over
as the other county charges.

Sec. 8 And be it enacted, That upon the appointment of a
clerk to the commissioners as aforesaid, the clerk of Cecil
county court shall upon demand of said clerk to the commis-
ioners, by order of the said commissioners, forthwith deliver
over to the said clerk of the commissioners, all the books,
accounts, papers and documents belonging, or in any manner
appertaining to the said levy court of said county, and shall an-
nually, on or before the second Monday of June, furnish to,

and lay before the said commissioners, all copies of such lists,
accounts, papers and documents, as may be useful and neces-
sary to the said commissioners in ascertaining the county
charges, and according to the directions which he may from
time to time receive from the said commissioners, for which
services he shall have and receive such fees as by law he is
entitled for like services; and in case said clerk of Cecil county
court shall neglect or refuse to comply with any oi the provi-
sions or requisitions contained in this act, when called on
by the said commissioners or the clerk thereof, by their order
thereafter, he shall for every such neglect or refusal, forfeit
and pay to the said commissioners, lor the use of the said
county, the sum of one hundred dollars, to be recovered by
indictment or action in Cecil county court.

SEC. 9, And be it enacted, That it shall be the duty of the
commissioners at their first meeting, or within one month
thereafter, to appoint some proper person to erect, or cause
to be erected, and fitted up in the court house of said county, a
suitable book case, in which the books, papers and documents,
belonging to the commissioners may be safely deposited and
kept.

SEC. 10. And be it enacted, That each of the said commis-
sioners shall be entitled to receive two dollars per day, for ev-
cry d ty he shall necessarily attend to the duties of his office.

SEC. 11, And be it enacted, That the said commissioners,
shall and may at any time during each and every year, make
complete and close their levy, any law to the contrary not«
withstanding; and that all suits at law or in equity, which may
be pending at the time of the passage of this act, by or against
the justices of the levy court of said county, shall be carried
