CHAPTER 128
An act for the relief off Levin Tyler, guardian of Samuel C.
Broughton, Patty Ann Broughton and Rebecca Broughton,
Infant children of a certain Ann Broughton, late of Somerset
county, deceased.

WHEREAS it is represented by Levin Tyler, guardian of
Samuel C, Broughton, Patty Ann Broughton and Rebecca
Broughton, infant children of a certain Ann Broughton, that
said Ann Broughton, the mother of said infants, devised cer-
tain valuable real estate in Somerset count}, in unequal por-
tions, to said infants, and died without leaving personal estate
sufficient to pav her debts; anrl that the deficiency of the said
personal estate is far less than the value of the said lands,
and unless the balance due by their mother's real estate be
paid by the said children, these lands will be sold to pay said
debts. And the said guardian further represents, that he has
monies of said infants in his hands as their guardian, sufficient
to pay off the incumbrance of said! land, and that he is of opi-
nion that it would be advantageous to said infants so to apply
it: Therefore,

SECTION 1. Be it enacted by the General Assembly of Mary-
Iand, That Levin Tyier, guardian of Samuel C Broughton,
Patty Ann Broughton and R.becca Broughton, infant chil-
dren and devisees of Ann Broughton, be, and he is hereby
authorised to pay out of the monies of said infants, such ba-
lance or sums due by their mother's real estate, on account of
and by reason of the deficiency of her personal estate

SEC. 2, And be it enacted, That the orphans' court of So-
merset county be authorised to appoint three judicious per-
sons to value the respective distinct interests of said infants in
the said lands, and report the same to the said orphans' court;
and the said guardian shall out of the monies of said children
respectively, pay each of said childrens7 respective portion of
said balance, according to, such valuation, and for such pay-
ment shall be allowed in his guardian's account with the res-

pective children: Provided, That this act be of no effect unless,
the orphan's court of Somerset county shall deem the applica-
tion and payment herein mentioned advantageous to said
infants, and pass an order for such application and payment,
which order the said court is hereby empowered to make, if
they deem such order proper.
