CERTIFICATION OF THE CODE—OPINION AND
LETTER OF THE ATTORNEY GENERAL

At the suggestion of the late Judge Carroll T. Bond, who was then
Chairman of the Hall of Records Commission, the Archivist asked, in
1941, for an official opinion as to whether he could certify printed portions
of the Annotated Code. The Opinion reprinted here below from Annual
Report and Official Opinions of the Attorney General, vol. 26, pp. 1834,
held that the Archivist did not have that authority.

The problem is far from academic, for attorneys from outside the State
need, or feel that they need, certified sections of the Code whenever Mary-
land law is involved. Since it is the Hall of Records which is custodian of
the original Acts of Assembly (deposited by the Court of Appeals after
one session has intervened), we do have authority to certify these Acts.
It is natural for attorneys to suppose that if any agency has authority to
certify the Code, it is the Hall of Records. After receiving the opinion
of the Attorney General, we inquired of other State agencies whether they
