1. And be it enacted, That nothing herein contained shall
be taken or understood to prevent the authorised agent of the
United States from making a purchase of the property that may
be required for the establishment of said light-house, dwelling
and out-houses, and a garden patch.

8. And be it enacted, That the property so purchased, and
not, exceeding- one acre, shall he ceded to the said United States,
in the same manner as if the commissioners had met, valued
end condemned the property.

9. And be it enacted, That if no such purchase should be
made by the .agent aforesaid, by the first day of May next,
then upon application to the said commissioners, by the agent
of the United States, the said Commissioners shall meet and
proceed in the manner prescribed by this act

CHAP. CCII.
An Act to open ami extend Pine Street in the City of Baltimore.
1. Be it enacted by the General Assembly of Maryland,
That Thomas Finley, John J. Donaldson, Dennis A, Smith,
Robert Neilson and John Smith Hollins, Esquires, be appoint-
ed commissioners to open and extend Pine-street in the city of
Baltimore, and they, or a majority of them, are hereby autho-
rised and empowered to open and extend said street, of the
width of fifty feet, in a southerly direction from the intersecti-
on of Fayette and Pine-streets to Baltimore-street, and of the
width of seventy feet from Baltimore-street to German-street;
and the said street, when opened and extended, and the valua-
tion and assessment herein after directed to be made shall have
taken place, shall be deemed and considered, and is hereby de-
clared, a public street and high-way forever thereafter, aad the
said commissioners, or a majority of them, are hereby directed
to return a plot, ascertaining the limits and extent of that part
of said street so opened and extended, to the clerk of Baltimore
county court, who shall receive and file the same in his office.

2. And be it enacted. That the said commissioners, or a ma-
jority of them, shall give ten days notice in two or more news-
papers printed in the city of Baltimore, of their appointment, as
also of the time and place of meeting, which shall be on the
premises, and shall then and there proceed to the duties herein-
after enjoined ; but before they proceed, they shall take an oath,
or affirmation, as the case may be, that they will faithfully and
impartially assess and value what damages will be sustained by
opening and extending the said street, taking into consideration
all advantages and disadvantages; they shall then proceed to as
sess and value what damages will be sustained by any person or
persons whomsoever, by opening and extending said street, and
shall also declare what sum of money each individual benefited
thereby shall pay towards compensating the person or persons
injured by opening and extending said street, and the names of
the person or persons, and the sums of money which they shall
respectively be obliged to pay, shall be returned, under their
hands and seals to the clerk aforesaid, to be filed and kept in
his offices; and the person or persons benefited by opening of
said street, and assessed as aforesaid, shall respeetively pay the
