her of papers in which it shall be inserted, and the number of
insertions in each paper, but shall not name such pnper or pa-
pers in such order of publication, but leave to the party, at
whose expense such notice or advertisement is to be published,
to select the paper or papers, in which the same shall be insert-
ed, and to contract for the cost of such insertion and publica-
tion, any thing in any law, usage or rule, to the contrary not-

withstanding; Provided always, that when such publication
shall be ordered to be made in the city of Baltimore, it shall
not be considered a compliance with such order, unless the no-
tice or advertisement shall be inserted in one or more of the
daily newspapers, as may be directed, published in said city,

CHAP. CLXXIX.
An Act to alter the mode of appointing Commissioners of the Tax for
Somerset County.
1. Be it enacted by the General .Assembly of Maryland,
That the justices of the levy court of Somerset bounty shall
meet at Princess-Anne, as soon after the passage of this act as
may be practicable, and are hereby authorised and required to
appoint five sensible, discreet and experienced persons in said
county, to be commissioners of the tax for said county.

2. And be it enacted, That if any one or more cf the com-
missioners aforesaid shall die, resign, refuse, neglect, or be
rendered incapable to act by removal outfof. the county, or
Otherwise, the remaining commissioners, or a majority of them,
of Somerset county, shall immediately, or as soon as they con-
veniently can, proceed to fill up such vacancy or vacancies, and
shall thereupon signify to such person or persons, the appoint-
ment by them, made in writing, and the commissioners so ap-
pointed shall continue to act until their powers shall be super-
seded by some future act of assembly, provided that no mem-
ber of the levy court, or orphans court, or register of wills,
shall be a commissioner of the tax.

3. And be it enacted. That the commissioners of the tax for
Somerset county, when so appointed, are hereby authorised
and empowered to carry into full effect and operation all the
provisions of an act, passed at November session eighteen hun-
dred and twelve, entitled, An act for the valuation of the real
and personal property in the several counties of this state.

4. And be it enacted, That the commissioners of the tax
for Somerset county, appointed by an act of the general assem-
bly, entitled, An act for the valuation of the real and personal
property in Somerset county, passed at December session eigh-
teen hundred and twenty -two, chapter seventy-five, shall im-
mediately, when required by the commissioners of the tax ap-
pointed agreeably to the provisions of this act, deliver over all
their books to the said commissioners so appointed.
