ty-four, he entrusted a certain claim of forty-three dollars and
twenty cents, which he the said Jacob had and held against one
Michael Baer, deceased, to a certain Alexander Getzendanner,

af stated in the said ninth allegation aforesaid; Provided that he
complies with the other requisites of the several insolvent laws;
And provided also, that before the said Jacob Getzendanner
shall take any benefit of this act, he shall pay and satisfy to the
creditor or creditors, by whom the allegations aforesaid were
preferred against him, ail costs accruing upon the prosecution of
the same, for which the said Jacob Getzendanner is by law re-
sponsible.

CHAP, CXJLII.
An Act for the establishment of a Road, and the condemnation of Land for
its repair, in Kent County.
|

1. Be it exacted by the General Assembly of Maryland,
That the road running by Doctor Thomas Willson's gate to
Eastern Neck Island Bridge, and thence by William R. Dur-
din<^s gate in Kent county, and now open and in common use,
shall hereafter be a public highway, and that the same shall fe§
tept in repair as other public roads in the county are.

2. Jlnd be it. enacted^ That Samuel Ifodges, Thomas Miller,
Merit Miller, William Crane and Alexander W. Ringgold, b$
and they are hereby appointed commissioners, who, or a major
rity qf them, shall have power and authority to locate and con-
demn suitable parcels of ground, adjacent to said road, as they
may deem necessary for the purpose of keeping the same in
repair; that the said parcels of land, so to be condemned, shall
not exceed two acres; that the said commissioners, or a majori-
ty of them, shall ascertain whatever damages any person or
persons may sustain in consequence of the condemnation of the
said parcels of land, or any of them, that they shall also mark
and bound the said parcels of land, and cause a plat or plats,
and certificate of the same, to be made out, which assessment
of damages, together with the plats and certificates, and a full
report of the proceedings under the hands and seals of the said
commissioners, or a majority of them, shall be returned to the
levy court of Kent county, which proceedings shall be record-
ed by the clerk of the county.

3. And be it enaeted, That the said commissioners, before
they proceed to act, shall give fifteen days notice of the time
and place of their meeting, by advertisement set up at three or
more public places in the neighbourhood of said road, and shall
also take an oath to perform the duties assigned them by this
act, according to the best of their skill and judgment.

4. And be it enacted, That the levy court of Kent county
be and they are hereby authorised and required, to levy upon
the assessable property of the county the damages so ascertain-
ed, and a compensation of two dollars per day for each com-
missioner, for each and every day he may have served in vir-
tue of this act, and to have the same collected and paid to the
persons respectively, for whom the levy shall be made.
