stances, and he therefore prays that a law may pass to aid and
effect the premises set forth; Therefore,
1. Be it enacted by the General Assembly of Maryland,
That the register of the land office of the western shore be and
he is hereby authorised and directed, to issue two patents to
Charles Carroll of Carrollton, on the two warrants aforesaid,
whenever the same shall be returned into the office.

CHAP. CXXXVI.
An Act to incorporate the Pennsylvania and Maryland Canal Company.
1. Se it enacted by the General Assembly of Maryland,
That five commissioners shall be appointed by the governor and
council, on the part of the state of Maryland, to act for the pur-
poses hereinafter mentioned, conjunction with an equal num-
ber of commissioners, to be appointed by the state of Pennsyl-
vania, on giving its assent to the passage of this law; and that as
soon as these commissioners shall be appointed on the part of the
two states, they, or a majority of the whole number of them
shall cause books to be opened, at such times and places as the
may appoint, for the purpose of receiving subscriptions to the
capital stock of the company hereinafter incorporated, having
first given notice of the time and place of opening said books
as they may deem proper, and that they shall keep said books
open for at least twenty days successively after the opening of
the same; and if at the expiration of that period such a sub-
scription shall not have been obtained to the capital stock of the
company hereby incorporated, as is herein made necessary to
its organization, the said commissioners may keep the said books
open from time to time, after the expiration of said twenty
days, for the space of twelve months after the same were first
opened, or until the sum necessary to the organization of the
company is subscribed, if sooner subscribed; and if any of the
said commissioners, appointed on the part of the two states
shall die, resign, or refuse to act, before the powers and duties
devolved upon them by this act shall have been fully exercised
or discharged, a proper person to fill such vacant place shall be
appointed by the executive of that state, on whose part said
commissioners dying, resigning, or refusing to act, was appoint
ed.

2. And be it enacted, That the capital stock of the company
hereby incorporated shall be two million five hundred thousand
dollars, in shares of one hundred dollars each, payable in the le-
gal currency of the United States, which may be subscribed for
by any state, corporation, or individual; and that as soon as eight
thousand shares of said capital stock shall be subscribed, the sub-
scribers thereof shall be, and are hereby declared to be, incor-
porated into a company, by the name of The Pennsylvania and
Maryland Canal Company, and for the purpose of constructing
canal from the termination of the Pennsylvania state canal, on
the river Susquehanna, at or near Swatara creek, to tide water
in the Susquehanna river, and thence to the city of Baltimore
and by said corporate name, the said subscribers may sue and
be sued, may have a common seal, and change the same at their
pleasure, shall hare perpetual succession, and as such shall have
