(d) Prosecution of a person under this section does not preclude prosecution
and imposition of penalties for any other crime in addition to any penalties imposed
under this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.

AN ACT concerning

Baltimore City - Pub-Brewery License - Off-Sale

FOR the purpose of authorizing a holder of a Class 6 pub-brewery license in Baltimore
City to sell malt beverages for off-premises consumption in returnable sealed
refillable containers under certain circumstances; requiring the State Comptroller
to approve the size and lid of the containero and the method for sealing the
containers;
prohibiting a holder of a certain pub-brewery license in Baltimore City
from selling malt beverages to certain retail alcoholic beverages licensees for
certain purposes; and generally relating to pub-brewery licenses in Baltimore City
and the off-premises sale of malt beverages.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

5.

(g) (7) (I) 1. IN BALTIMORE CITY, THE HOLDER OF A CLASS 6
PUB-BREWERY LICENSE MAY SELL MALT BEVERAGES FOR
OFF-PREMISES CONSUMPTION IN SEALED RETURNABLE REFILLABLE
CONTAINERS.

2. (II) THE CONTAINERS MAY BE RETURNED AND

AT THE TIME OF REFILL SHALL BE SEALED BY THE PUB-BREWERY
LICENSEE.

(H) THE REFILLABLE CONTAINERS AND THE LIDS SHALL
