Section 54-1.A. and D.
Article 9 - Public Local Laws of Maryland
(As enacted by Chapter __ (Olr0990) of the Acts of the General Assembly of
1990)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 9 - Charles County
54-1.
A. Fire and rescue tax authorized; rate. The County Commissioners [of Charles
County are hearby authorized and directed to] SHALL levy for [the] EACH fiscal year
[beginning July 1, 1984, and annually thereafter,] a fire and rescue tax at the rate of
[fifteen] SIXTEEN cents [$0.15] per [one hundred dollars] ($100.) $100 of assessed
value. [Such] THE tax shall be levied on the assessed value of all taxable real and
personal property in Charles County.
D. The Board of Fire and Rescue Commissioners shall review AND MAKE
RECOMMENDATIONS CONCERNING the financing of the fire departments and
rescue squads including mobile intensive care units in Charles County [and make
appropriate recommendations with respect thereto]. Distribution of [funds,
constituting] the proceeds [fo] OF the fire and rescue tax [,] shall be to the various fire
departments, rescue squads, and mobile intensive care units in accordance with a
formula agreed [upon] ON by the Board of Fire and Rescue Commissioners and the
Executive Committee of the Charles County Volunteer Firemen's Association and the
executive committee of the Charles County Association of Emergency Medical
[Services, providing, however, that if such] SERVICES. IF AN agreement cannot be
reached the formula employed in the previous year's distribution shall continue in use
until [such] AN agreement is reached. [The funds] EACH SIXTEEN CENTS received
from the fire and rescue tax shall be allocated and distributed as follows:
(1) [Revenue derived from ten cents of the fire and rescue tax shall be
distributed] TEN CENTS to the various fire departments of Charles County.
(2) [Revenue derived from four cents of the fire and rescue tax shall be
distributed] FIVE CENTS to the various rescue squads and mobile intensive care units
of Charles County.
(3) [Revenue derived from one cent of the fire and rescue tax shall] ONE
CENT TO be used to provide funds to pay for the funded length of service award
described in § 54-8 of this chapter.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.
