to the retail establishment during normal business hours for the purpose of developing
prefire strategy.

(d) Except as provided in subsection (b) of this section or § [32L] 32H of this
subtitle, information submitted or made available pursuant to this section shall be
privileged and may not be disclosed to any person or in any civil proceeding.

[32J.

(a) This section does not apply to:

(1) Retail establishments with respect to chemicals intended for sale to the
general public; or

(2) Any consumer product or foodstuff that is:

(i) Packaged for distribution to and intended for use by the general
public; and

(ii) Handled or stored unopened in a retail establishment, including
its storeroom or warehouse.

(b) A manufacturer and any distributor shall provide to a purchaser of any
hazardous chemical a material safety data sheet containing the information required by
§ 32F(b) of this subtitle.

(e) A manufacturer or distributor who has complied with subsection (b) of this
section in a previous sale or shipment of a hazardous chemical shall only be required to
provide information that would update the material safety data sheet which was
previously given to the purchaser.

(d) A purchaser who has not received from a manufacturer or distributor the
information required under this section shall request the required information within 5
days after delivery of the hazardous chemical.]

[32K.] 32G.

(a) An independent contractor or employer to whom this subtitle is applicable
shall:

(1) Provide information compiled pursuant to § [32E] 32D of this subtitle
to any other employer whose workplace is the site of work being performed by the
independent contractor or employer, prior to commencement of work at the workplace;
and

(2) Provide, on request, [information compiled under § 32F of this
subtitle] MATERIAL SAFETY DATA SHEETS FOR EACH HAZARDOUS
CHEMICAL IDENTIFIED ON THE CHEMICAL INFORMATION LIST to any
other employer whose workplace is the site of the work being performed by the
independent contractor, within 1 working day.

(b) Any employer who employs an independent contractor shall provide the
