effect for a period of [3] 5 years and, at the end of January 1, [1991] 1993, with no
further action required by the General Assembly, these changes shall be abrogated and
of no further force and effect.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health
and safety, has been passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two Houses of the General Assembly, and shall take
effect from the date it is enacted.

(Senate Bill 196)

AN ACT concerning

Firearms - Disapproval of Purchase or Transfer - Hearing

FOR the purpose of providing that if an applicant for the purchase or transfer of a
pistol, revolver, or certain assault weapons requests a hearing to challenge the
disapproval of the purchase or transfer, the hearing shall be held at the Maryland
State Police barrack closest to
in the county of the legal residence of the
applicant; and providing that if the applicant is not a State resident, the hearing
shall be held at a location designated by the Superintendent of the Maryland State
Police.

BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
Section 442(h)
Annotated Code of Maryland
(1987 Replacement Volume and 1989 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

442.

(h) (1) Any prospective purchaser or transferee aggrieved by the action of the
State Police may request a hearing within 30 days from the date when written notice was
forwarded to [such] THE aggrieved person by writing to the Superintendent of State
Police, who shall grant the hearing within fifteen days of [said] THE request.

(2) THE [Said] hearing and subsequent proceedings of judicial review, if
any, thereupon following shall be conducted in accordance with the provisions of the
Administrative Procedure Act.
