INSTITUTION OF HIGHER EDUCATION, A RECOGNIZED SCIENTIFIC OR
HISTORICAL INSTITUTION OR ORGANIZATION, OR THE TRUST.

5-628.

(A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, A
PERSON MAY NOT EXCAVATE, REMOVE, DESTROY, INJURE, DEFACE, OR
IN ANY MANNER DISTURB ANY BURIAL GROUNDS, HISTORIC OR
PREHISTORIC RUINS, OR ARCHAEOLOGICAL SITE OR ANY PART OF ANY
SUCH BURIAL GROUNDS, RUINS, OR SITE, INCLUDING RELICS,
INSCRIPTIONS, SALTPETER WORKINGS, FOSSILS, BONES, REMAINS OF
HISTORICAL HUMAN ACTIVITY, OR ANY OTHER ARCHAEOLOGICAL,
PREHISTORIC, AND HISTORIC FEATURES WHICH MAY BE FOUND IN ANY
CAVE.

(B) (1) A PERSON TRAINED IN ARCHAEOLOGY MAY REQUEST A
PERMIT FROM THE TRUST TO EXCAVATE OR REMOVE
ARCHAEOLOGICAL, PREHISTORIC, AND HISTORIC FEATURES FROM A
CAVE ON LAND THE STATE OWNS OR CONTROLS CONSISTENT WITH THE
PROVISIONS RELATING TO PERMITS FOR TERRESTRIAL SITES SET FORTH
IN §§ 5-625 THROUGH 5-627 OF THIS SUBTITLE.

(2) (I) A PERSON TRAINED IN ARCHAEOLOGY MAY REQUEST
A PERMIT FROM THE TRUST TO EXCAVATE OR REMOVE
ARCHAEOLOGICAL, PREHISTORIC, AND HISTORIC FEATURES FROM A
CAVE ON PRIVATELY OWNED LAND SUBJECT TO THE FOLLOWING
PROVISIONS:

1. THE PERMIT MAY BE ISSUED FOR A PERIOD OF UP
TO 2 YEARS AND MAY BE RENEWED AT EXPIRATION.

2. THE PERMIT IS NOT TRANSFERABLE BUT DOES

NOT PRECLUDE PERSONS FROM WORKING UNDER THE DIRECT
SUPERVISION OF THE PERSON HOLDING THE PERMIT.

3. A PERSON APPLYING FOR A PERMIT SHALL:
A. BE TRAINED IN ARCHAEOLOGY;

B. PROVIDE A DETAILED STATEMENT TO THE

TRUST GIVING THE REASONS AND OBJECTIVES FOR EXCAVATION OR
REMOVAL AND THE BENEFITS EXPECTED TO BE OBTAINED FROM THE
CONTEMPLATED WORK;

C. AGREE TO PROVIDE DATA AND RESULTS TO THE

TRUST OF ANY EXCAVATION, STUDY, OR COLLECTION IN ACCORDANCE
WITH THE TERMS OF THE PERMIT;

D. OBTAIN THE PRIOR WRITTEN PERMISSION OF
THE OWNER; AND
