SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take

AN ACT concerning

Oyster Leases

FOR the purpose of consolidating and altering certain oyster lease application fees;
making the application fee nonrefundable; altering certain notice requirements;
repealing certain provisions relating to the issuance of certain oyster leases;
providing that requiring the Department of Natural Resources may to make
certain initial determinations concerning the status of certain areas proposed for
lease; requiring the Department to deny a lease application under certain
circumstances; requiring that leases be actively utilized within a certain time;
altering certain time periods for utilizing newly issued leases; requiring lessees to
maintain certain records; clarifying that the State landlord and tenant law is not
applicable to oyster leases; providing for contested case proceedings in certain
circumstances; defining a certain term; and generally relating to oyster leases.

(b) (1) THERE IS AN APPLICATION FEE OF $300. THE FEE IS NOT
REFUNDABLE AND SHALL BE USED TO PAY FOR THE DEPARTMENT'S
COSTS ASSOCIATED WITH PROCESSING APPLICATIONS AND RECORDING
LEASES.
