WILLIAM DONALD SCHAEFER, Governor

WHEREAS, The Court was required by law to impose a mandatory five year sentence
for the Use of a Handgun in the Commission of a Felony; and

WHEREAS, The Court has recommended that the appropriate sentence on the
handgun charge would have been eighteen months on a work release program had
the law not required a five year sentence to the custody of the Division of
Correction; and

WHEREAS, The Court has recommended a Commutation of the mandatory five year
sentence; and

WHEREAS, The Parole Commission has recommended a Commutation of the
mandatory five year sentence; and

WHEREAS, The interest of justice would best be served by commutation of the five
year sentence;

NOW, THEREFORE, I, WILLIAM DONALD SCHAEFER, GOVERNOR OF THE
STATE OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN
ME BY THE CONSTITUTION AND LAWS OF MARYLAND, HEREBY
ORDER THAT THE ORIGINAL FIVE YEAR SENTENCE TO THE
CUSTODY OF THE DIVISION OF CORRECTION FOR USE OF A
HANDGUN IN THE COMMISSION OF A FELONY IMPOSED UPON
HARRY NICHOLAS KARVOUNIS, GRANTEE, BE COMMUTED AS
FOLLOWS:

A. Grantee shall serve one full year from March 31, 1989 in the custody of the
Division of Correction without diminution of credits.

B. Grantee shall then be placed on work release for a term of six months.

C. Grantee shall then be released from the custody of the Division of
Correction and shall be supervised by the Division of Parole and Probation, as if
otherwise on parole, for the balance of the five year sentence originally imposed.

WHEREAS, Ozone levels in Maryland have exceeded the federal air quality standard
and are not expected to improve; and

WHEREAS, Repeated exposure to ozone increases the likelihood of permanent
impairment of the lungs; and

WHEREAS, State government must demonstrate its leadership and commitment to
clean air and protecting the public health of our citizens;
