SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 56 - Licenses
161.
(A) [No] EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS
SECTION, NO person, firm or corporation shall open, operate, or maintain an
employment agency in this State, nor shall any person on or after January 1, 1974, act in
the capacity of an employment counselor without first obtaining a license for that
purpose from the Commissioner of the Division of Labor and Industry. Any person,
firm or corporation opening, operating or maintaining an employment agency, and any
person acting in the capacity of an employment counselor, without first obtaining a
license for that purpose from the Commissioner of Labor and Industry shall be guilty of
a misdemeanor, and upon conviction thereof shall be subject to a fine not to exceed one
thousand dollars or to imprisonment not to exceed one year, or both such fine and
imprisonment.
(B) A NURSING STAFF AGENCY REGISTERED IN ACCORDANCE
WITH THE PROVISIONS OF TITLE 19, SUBTITLE 15 OF THE HEALTH -
GENERAL ARTICLE IS NOT REQUIRED TO OBTAIN A LICENSE UNDER
THIS SUBTITLE.
Article - Health - General
SUBTITLE 15. NURSING STAFF AGENCY REGISTRATION
19-1501.
(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(B) "HEALTH CARE FACILITY" MEANS A HOSPITAL OR RELATED
INSTITUTION AS DEFINED IN § 19-301 OF THIS TITLE.
(C) "NURSING PERSONNEL" MEANS ANY INDIVIDUAL LICENSED BY
THE BOARD OF NURSING AS A:
(1) LICENSED PRACTICAL NURSE; OR
(2) REGISTERED NURSE.
(D) (1) "NURSING STAFF AGENCY" MEANS ANY PERSON, FIRM,
CORPORATION, PARTNERSHIP, OR OTHER BUSINESS ENTITY ENGAGED
IN THE BUSINESS OF PROCURING, FURNISHING, OR REFERRING
NURSING PERSONNEL TO RENDER TEMPORARY NURSING SERVICES AT
A HEALTH CARE FACILITY OR IN A PERSONAL RESIDENCE.
(21 "NURSING STAFF AGENCY" DOES NOT INCLUDE A PERSON
RENDERING PRIVATE DUTY NURSING CARE AT A HEALTH CARE
FACILITY.
