SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect January 1, 1991.

AN ACT concerning

Stormwater Management - Enforcement

FOR the purpose of authorizing the Department of the Environment to issue certain
complaints, orders, and written notices for certain stormwater management
violations; specifying that before the Department takes certain action in response
to a violation, the Department must notify a county or municipality of the
intended action and conduct a certain joint inspection with the county; providing
certain criteria for issuing any complaint, order, or notice; providing for certain
hearings and notice under certain circumstances; authorizing the Department
certain subpoena powers; providing certain remedies for failure to comply with a
subpoena; establishing certain provisions for an order to become a final corrective
order; authorizing the Department to take certain actions to secure compliance
with a certain order; providing for a judicial appeal under certain circumstances;
altering the amount of civil penalties that may be imposed for a violation of
certain laws; providing that a civil penalty may be imposed in conjunction with
other certain penalties; authorizing the imposition of administrative civil penalties
for certain violations; providing that before any action may be taken the
Department shall provide the alleged violator an opportunity for a hearing;
providing certain criteria to be used in assessing civil penalties; authorizing the
Attorney General to take certain actions on behalf of the State under certain
circumstances; and generally relating to enforcement of the laws controlling
stormwater management.
