Ch. 644 LAWS OF MARYLAND

Harford County - Alcoholic Beverages Licenses - Sales Requirements

FOR the purpose of repealing a certain monthly sales receipt requirement for certain
Harford County alcoholic beverages licensees; repealing a certain alcoholic
beverages sales provision in Harford County relating to normal containerized
packages; providing for the sale of brewed beverages in the County in
containerized packages of a certain minimum number of bottles or containers;
making a technical change; and generally relating to Harford County and alcoholic
beverages license sales requirements.

BY repealing and reenacting, with amendments,
Article 2B - Alcoholic Beverages
Section 13(h) and 14(g)(3)
Annotated Code of Maryland
(1987 Replacement Volume and 1989 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

13.

(h) (1) In Harford County the annual license fee for a six day, Monday
through Saturday, license is $125.

(2) The fee for a seven day license is $250.

(3) The licenses shall be granted by the liquor control board of Harford
County only to proprietors of bona fide retail stores selling food, drugs, or other similar
commodities [amounting to at least 20 percent of the total monthly receipts]. These
licenses authorize the licensee to sell for consumption off the premises only[,]
fermented beverages, including split bottles and brewed beverages [in normal
containerized packages]. Brewed beverages sold in bottles or cans exceeding 12 ounces
in weight or size, for consumption off the premises, may be sold individually. IF
BREWED BEVERAGES ARE SOLD IN A CONTAINERIZED PACKAGE, THE
PACKAGE SHALL HOLD A MINIMUM OF 6 BOTTLES OR CONTAINERS. Wine
and other fermented beverages may not contain more than 23 percent of alcohol by
volume. The word "premises" for the purpose of this section shall be construed to
include any building, parking lot, terrace or grounds which form an integral part of the
licensed premises.

(g) (3) The licenses [authorized] AUTHORIZE the licensees to sell for
consumption on the premises wine and other fermented beverages as defined in this
article with an alcoholic content by volume of no more than 23% by volume. As to any
Class B-l or B-2 restaurant license issued prior to July 1, 1984, "off-sales" of licensees
shall be limited to fermented beverages including split bottles and brewed beverages [in
normal containerized packages]; provided that brewed beverages sold in bottles or cans
