AN ACT concerning

Pensions - Transfers - Police or Fire Department Systems

FOR the purpose of requiring that on certain transfers to certain police department or
fire department retirement or pension systems, the years of service necessary for
retirement and the years of service and amount of benefits to be credited shall be
determined by a certain method; prohibiting certain retirement or pension systems
from which certain transfers are made from providing certain benefits; providing
for the application of this Act; and generally relating to transfers to police
department or fire department retirement or pension systems operated by the
State or a political subdivision of the State.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

32.

(E) (1) THIS SUBSECTION APPLIES TO A TRANSFER ON OR AFTER
JULY 1, 1990.

(2) NOTWITHSTANDING THE REQUIREMENTS OF
SUBSECTIONS (A) THROUGH (D) OF THIS SECTION, WHEN A MEMBER OF
A RETIREMENT OR PENSION SYSTEM OPERATED BY THE STATE OR A
POLITICAL SUBDIVISION OF THE STATE TRANSFERS TO A POLICE
DEPARTMENT OR FIRE DEPARTMENT RETIREMENT OR PENSION SYSTEM
OPERATED BY THE STATE OR A POLITICAL SUBDIVISION OF THE STATE,
THE PLANS, RULES, REGULATIONS, GUIDELINES, AND POLICIES OF THE
RETIREMENT OR PENSION SYSTEM INTO WHICH THE MEMBER
TRANSFERS SHALL GOVERN IN DETERMINING:

(I) THE YEARS OF SERVICE NECESSARY TO QUALIFY THE
MEMBER FOR RETIREMENT FROM THE RETIREMENT OR PENSION
SYSTEM INTO WHICH THE MEMBER TRANSFERS; AND
