AN ACT concerning

Wicomico County Department of Corrections - Correctional Programs

FOR the purpose of authorizing the Wicomico County Council to establish and
administer pretrial release, work release, community service, and home detention
programs; authorizing a court in Wicomico County to sentence allow individuals
to participate in pretrial release, work release, community service, or home
detention programs; requiring certain prisoners to reimburse the county detention
center for certain expenses; allowing inmates to be removed from the programs
and providing certain penalties for violations of certain conditions; defining a
certain—term; providing for compassionate leave; and generally relating to
correctional programs in Wicomico County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

645GG.

(A) (1) THE WICOMICO COUNTY COUNCIL MAY ESTABLISH THE
FOLLOWING PROGRAMS UNDER THE WICOMICO COUNTY DEPARTMENT
OF CORRECTIONS:

(I) PRETRIAL RELEASE;

(II) WORK RELEASE;

(III) COMMUNITY SERVICE; AND

(IV) HOME DETENTION.

(2) THE WICOMICO COUNTY COUNCIL SHALL ADOPT
REGULATIONS NECESSARY TO IMPLEMENT THE PROGRAMS
ESTABLISHED UNDER THIS SECTION.

(B) IN WICOMICO COUNTY, WHEN AN INDIVIDUAL WHO HAS NO
OTHER CHARGES PENDING IN ANY JURISDICTION IS SENTENCED TO THE
CUSTODY OF THE DIRECTOR OF THE WICOMICO COUNTY DEPARTMENT
OF CORRECTIONS, THE COURT MAY, AT THE TIME OF SENTENCING OR
