Article 64A - Merit System
Section 48B

Annotated Code of Maryland
(1988 Replacement Volume and 1989 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article 64A - Merit System

48B.

(a) As used in this section, the following terms have the meanings indicated:

(1) "Beneficiary" means [an]:

(I) A FORMER employee, judge, teacher, or correctional officer
receiving a retirement allowance under the provisions of Article 73B or Article 88B,
excluding faculty and staff of community colleges and teachers and staff employed by
local boards of education; OR

(II) A FORMER EMPLOYEE OF THE UNIVERSITY OF
MARYLAND MEDICAL SYSTEM CORPORATION WHO RECEIVES A
RETIREMENT ALLOWANCE FROM THE EMPLOYEES' RETIREMENT
SYSTEM OR THE PENSION SYSTEM FOR THE EMPLOYEES OF THE STATE
OF MARYLAND UNDER THE PROVISIONS OF ARTICLE 73B, §§ 163
THROUGH 170, INCLUSIVE.

(2) "Creditable service" means:

(i) Service credited toward a retirement allowance under Article 73B
or Article 88B; or

(ii) For a judge, service as a judge.

(3) "Designated beneficiary" means a spouse or dependent child.

(4) "State service" means:

(I) [service] SERVICE with the State as an employee, judge,
teacher, or correctional officer as defined in Article 73B, §§ 1(3), 55(f), 81(3), 111(4),
140(4), and 156(a), and Article 88B, § 49(3); OR

(II) SERVICE AS AN EMPLOYEE OF THE UNIVERSITY OF
MARYLAND MEDICAL SYSTEM CORPORATION WHILE A MEMBER OF THE
EMPLOYEES' RETIREMENT SYSTEM OR THE PENSION SYSTEM FOR THE
