Ch. 6 LAWS OF MARYLAND

private property shall be liable for any damage he causes to the private property while
hunting. The landowner is not liable for accidental injury or damage to the person,
whether or not the landowner [, his] OR THE LANDOWNER'S agent[,] or lessee gave
the permission to hunt.

(b) (1) A person may not upon any pretense come to hunt on the lands owned
by another person without the written permission of the landowner[, his] OR THE
LANDOWNER'S agent[,] or lessee. Any person hunting on this private property is
liable for any damage [he] THE PERSON causes to the private property while hunting
on [it] THE PRIVATE PROPERTY. The landowner [shall not] MAY NOT be liable
for accidental injury or damage to the person whether or not the landowner or [his]
THE LANDOWNER'S agent gave permission to hunt on [it] THE PRIVATE
PROPERTY.

(c) In Allegany, Anne Arundel, Baltimore, Carroll, Charles, Garrett, Frederick,
Wicomico, Somerset, Howard, or Worcester counties, a person may not enter or
trespass upon land owned by another person for the purpose of hunting deer on the
land with gun, rifle, bow and arrow, or any other means without first securing the
written permission of the landowner[, his] OR THE LANDOWNER'S agent[,] or
lessee. Any person hunting deer on land owned by another person shall exhibit written
permission upon the request of any Natural Resources police officer, any law
enforcement officer, [or] the landowner, [his] OR THE LANDOWNER'S agent[,] or
lessee. The Natural Resources police officer or any law enforcement officer shall arrest
any person hunting without written permission upon the request of the landowner[, his]
OR THE LANDOWNER'S agent[,] or lessee.

10-412.

(a) (1) During the open season or within 15 days of the opening, a person may
not place, distribute, authorize, [direct] DIRECT, or permit the distribution of any
wheat, corn, rice, other grain, salt, or any other feed of any kind, except for growing
crops, so as to lure migratory game birds to, by, or over any shooting site on property
where the hunting of migratory birds is permitted or takes place.

(2) However, this subsection does not prevent or make it unlawful to hunt
or attempt to hunt these game birds in or over standing or flooded crops, including
aquatics, or in or over any land or water where feed has been scattered solely as a result
of normal agricultural operations or other natural causes.

(b) A person may not hunt or attempt to hunt any migratory game birds if [he]
THE PERSON knows or in the exercise of reasonable diligence should have known that
wheat, corn, rice, grain, salt, or other feed of any kind has been placed, exposed, or
deposited in a location for the purpose of luring game birds to, by, or over a hunting
blind or site.

(c) In enforcing the provisions of subsection (a) OF THIS SECTION, there
shall be a presumption that the person, who has the custody or control of the land or
water on which wheat, corn, grain, salt, or other feed is scattered as a result of any
activity other than normal agricultural operations or other natural causes, placed,
distributed, or knowingly allowed the placement, exposure, or distribution.
