Ch. 492 LAWS OF MARYLAND

ASSESSMENTS TO BE LEVIED TO PAY THE COST OF THE IMPROVEMENT
AND ACQUISITION, OR ANY REASONABLE PORTION OF THE COST, AS
DETERMINED BY THE COUNTY COMMISSIONERS.

97-6. APPEALS.

A. ANY INTERESTED PERSON AGGRIEVED BY THE LEVYING OF
ANY BENEFIT ASSESSMENT UNDER THIS ARTICLE MAY APPEAL TO THE
CHARLES COUNTY CIRCUIT COURT WITHIN THIRTY (30) DAYS AFTER
THE FINAL ADOPTION OF THE ORDINANCE BY THE COUNTY
COMMISSIONERS.

B. THE COURT, SITTING WITHOUT A JURY, MAY HEAR AND
DETERMINE WHETHER:

(1) THE COUNTY COMMISSIONERS FULFILLED THE
REQUIREMENTS IMPOSED BY THIS ARTICLE; AND

(2) THE BENEFIT ASSESSMENTS WERE LEVIED UNDER THE
PROVISIONS OF THIS ARTICLE.

CHAPTER 104
ROADS AND BRIDGES

ARTICLE I
GENERAL REGULATIONS FOR PUBLIC ROADS

104-1. CONTROL AND REGULATION.

THE COUNTY COMMISSIONERS OF CHARLES COUNTY SHALL HAVE
THE CONTROL AND REGULATION OF THE PUBLIC ROADS AND BRIDGES
IN SAID COUNTY INSOFAR AS THE SAME SHALL NOT BE REGULATED BY
THE PROVISIONS OF §§ 104-1, 104-2, 104-3 AND 104-4 OF THIS CHAPTER.

104-2. COUNTY COMMISSIONERS DESIGNATED BOARD OF ROAD
COMMISSIONERS.

A. ASSUMPTION OF ROAD BOARD DUTIES; MEETINGS. ON JUNE 1,
1951, THE BOARD OF ROAD COMMISSIONERS OF CHARLES COUNTY
SHALL IMMEDIATELY RELINQUISH ITS OFFICES AND DELIVER TO THE
COUNTY COMMISSIONERS ITS FILES AND OFFICE EQUIPMENT AND ALL
MACHINERY AND MATERIAL WHICH MAY BE IN THE BOARD'S CUSTODY
OR CONTROL. THEREAFTER THE COUNTY COMMISSIONERS SHALL
ASSUME ALL THE DUTIES OF THE BOARD AND SHALL MEET ON THE
SECOND AND FOURTH TUESDAYS OF EACH MONTH AS THE BOARD OF
ROAD COMMISSIONERS OF CHARLES COUNTY.

B. CONTINUANCE OF LEGISLATIVE REFERENCES;
INTERPRETATION. ON AND AFTER THE DATE OF THE COUNTY
COMMISSIONERS ASSUME THEIR DUTIES AS ROAD COMMISSIONERS ALL
REFERENCES IN THE LOCAL LAWS APPLICABLE TO CHARLES COUNTY TO
