AN ACT concerning
Hospitals and Related Institutions - Psychologists' Use of Facilities and Staff Privileges
FOR the purpose of requiring certain hospitals and related institutions to provide for
use of facilities and staff privileges by licensed psychologists; restricting use of
facilities and staff privileges to psychologists meeting certain qualifications set by
the hospitals or related institutions; specifying that a hospital is not required to
grant admitting privileges to a psychologist or permit the exercise of certain
privileges without appropriate collaboration with a certain physician; specifying
that the decision of a certain physician shall govern in the event of a disagreement
concerning the patient's treatment; and generally relating to use of facilities and
staff privileges in hospitals and related institutions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

19-351.
(a) Except as provided in [subsection (b)] SUBSECTIONS (B) AND (D) of this
section, this subtitle does not affect the right of a hospital or related institution to
employ OR APPOINT staff.
(b) (1) A hospital or related institution that provides medical or surgical care
of the foot, other than incidental care, shall include, in its bylaws, rules, or regulations,
provisions for use of facilities by and staff privileges for qualified podiatrists.
(2) The hospital or related institution may restrict use of facilities and staff
privileges by podiatrists to those podiatrists who meet the qualifications that the
hospital or related institution sets for granting those privileges.
(c) (1) A hospital or related institution shall include in its bylaws, rules, or
regulations provisions for use of facilities by and staff privileges for qualified dentists.
(2) The hospital or related institution may restrict use of facilities and staff
privileges by dentists to those dentists who meet the qualifications that the hospital or
related institution sets for granting those privileges.
