Ch. 6 LAWS OF MARYLAND

A secured party named in a certificate of title, on written request of the owner,
shall disclose any pertinent information as to the security agreement and the
indebtedness secured by [it] THE SECURITY AGREEMENT in accordance with §
9-208[,] of the Commercial Law Article.

8-735.

The method provided in §§ 8-729 through 8-736 OF THIS SUBTITLE of
perfecting and giving notice of security interests is exclusive.

8-736.

(a) The Department shall prescribe and provide suitable forms of applications,
certificates of title, notices of security interests, and all other notices and forms
necessary to carry out §§ 8-729 through 8-736 OF THIS SUBTITLE.

(b) The Department may make necessary investigations to procure information
required to carry out §§ 8-729 through 8-736 OF THIS SUBTITLE.

8-737.

(c) The Department shall issue a historical watercraft identification plaque, of
[its] THE DEPARTMENT'S own design, to a person who applies to the Department
on a form [it] THE DEPARTMENT supplies. When prominently displayed on the
boat, a historical watercraft identification plaque shall entitle the boat owner to apply
to participate in parades, shows, and special displays. The historical watercraft
identification plaque may not qualify a boat for general recreational use.

8-738.

(a) A person may not operate or attempt to operate a vessel while the person:

(4) Is under the influence of any controlled dangerous substance, as
defined in Article 27, § 277 of the Code, unless the person is entitled to use the
controlled dangerous substance under the laws of [this] THE State.

(c) Unless the person charged with any violation of this section was unaware
that the alcohol, drug, combination of drugs, or combination of drugs and alcohol would
make the person incapable of safely operating a vessel, it is not a defense to any charge
of violating this section that the person is or was entitled to use the alcohol, drug,
combination of drugs, or combination of drugs and alcohol under the laws of [this]
THE State.

8-740.

(b) Notwithstanding THE PROVISIONS OF subsection (a) of this section, if a
person is convicted of any of the following boating safety violations in the operation of
a vessel, the person is required, as a condition of probation or sentencing, to
successfully complete a boating safety education course that is offered or approved by
the Department:

(1) Negligent operation;
