(2) ANY GUARDIANSHIP AND ADOPTION PROCEEDING
INITIATED BY A CHILD PLACEMENT AGENCY;

(3) ANY GUARDIANSHIP AND PROTECTIVE SERVICES
PROCEEDING CONCERNING A DISABLED PERSON; OR

(4) ANY CRIMINAL OR DELINQUENCY PROCEEDING IN WHICH
THERE IS A CHARGE OF CHILD ABUSE OR NEGLECT OR THAT ARISES
OUT OF AN INVESTIGATION OF SUSPECTED CHILD ABUSE OR NEGLECT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.

CHAPTER 301
(House Bill 131)

AN ACT concerning

Newsprint Recycling

FOR the purpose of imposing certain recycled content percentage requirements on the
newspaper industry on a statewide basis; if the requirements are not met by industry on
a statewide basis, requiring certain publishers of newspapers distributed in the
State to satisfy a certain recycled content percentage requirement or pay a certain
newsprint recycling incentive fee; requiring certain publishers of newspapers
distributed in the State to complete and file with the Secretary of the
Environment certain reports stating the weight of newsprint used by the publisher
and the weight of recycled materials in that newsprint; prohibiting the Secretary
from requiring the disclosure of the price paid by a publisher for certain newsprint;
establishing a State Recycling Trust Fund; providing that the net proceeds from
the newsprint recycling incentive fee shall be credited to the Fund; requiring the
Secretary of the Environment to administer the Fund; providing that the Fund
shall be used only to provide grants to counties to be used for local recycling plans
and to carry out the purposes of the Office of Recycling; allowing a publisher of a
newspaper to elect to be exempt from certain recycling requirements; providing
that a certain sales and use tax exemption does not apply if a publisher of a
newspaper elects to be exempt from certain recycling requirements; establishing a
Newsprint Recycling Board within the Department of Environment; providing for the
powers and duties of the Board; providing for the membership and terms and
qualifications of the members of the Board; authorizing .the Secretary requiring the
Board to excuse publishers of all or part of the recycled content percentage
requirements under certain circumstances; providing that if the Board fails to act on
an application for an excuse of these requirements within a certain period of time, the
application is deemed approved; prohibiting local governing bodies and their agencies
from imposing certain regulations, requirements, or taxes on publishers or distributors
