contract with said bidder for the printing so
enumerated, and if from any cause said bidder
shall fail to enter into said contract, the said
Clerk shall award the contract to the next
lowest responsible bidder who shall have filed
his bond as directed in section two of this act,

SEC. 4. And be it enacted, That if any per-
son shall bid for said printing and fail to enter
into contract with the said Clerk of the Court
of Appeals, it shall be the duty of the Attorney-
General of the State to enter suit in the name

of the State of Maryland, against the bond of
said bidder for the amount of difference be-
tween said bid and the next lowest responsible
bidder, in the Circuit Court of the county or
Superior Court of Baltimore city, where said
bidder resides, and said Court shall enter
judgment against said bond and issue execu-
tion thereon; and all moneys so received shall
be transmitted to the Comptroller of the
Treasury, and paid into the Treasury of the
State.

SEC. 5. And be it enacted, That it shall be
the duty of said Clerk of the Court of Appeals
to report to the General Assembly on the first
day of the session, the said contract, and his
action in regard thereto, including a report
of all bids received by him from all parties
whomsoever, that the money so to be paid
under said contract shall be due and payable
as follows: One-third at the end of sixty days
from the commencement of said session; one-

soon thereafter as the said contractor hath
fully and entirely completed the said contract;
and the Comptroller is hereby directed to
draw his warrants upon the Treasurer for such
payments at such times, but no such warrants
shall be drawn unless at the times thereof,
the said Clerk shall have certified in writing
to said Comptroller, that up to the time of
granting the said certificates the said printing
has been done and contract performed as by it
called for up to said time.
