Continuances.

alleges, and if, on such examination, the Court
is satisfied of the truth of the affidavit, and:
that the testimony is material and competent,
a continuance shall be granted, unless the ad-
verse party will admit that the facts which it
is so alleged the absent witness will prove, to be
in evidence to the same effect as if said absent
witness had testified thereto, saving, however,
to the adverse party the same right to impeach
or contradict said testimony as if said witness
had been present.

CHAPTER 312.
AN ACT to repeal section eighty-eight of art-
icle eighty-one of the Code of Public Gen-
eral Laws of the State of Maryland, entitled
"Revenue and Taxes," as amended and re-
enacted by the act of Assembly, passed at
January session, eighteen hundred and sev-
enty-four, chapter four hundred and eighty-
three, and to re-enact the same with amend-
ments.
SECTION 1. Be it enacted by the General As-
sembly of Maryland, That section eighty-eight
of article eighty-one of the Code of Public

re-enacted.

General Laws of the State of Maryland, enti-
tled "Revenue and Taxes," as amended and
re-enacted by the act of Assembly, passed at
January session, eighteen hundred and seventy
four, chapter four hundred and eighty- three,
be and the same is hereby repealed and
amended and re-enacted so as to read as fol-
lows :
