any person from taking oysters for private use,
and not for sale, from his private beds any-
where within this State at any time; any per-
son violating the provisions of this section

shall be deemed guilty of a misdemeanor, and
on conviction by a Justice of the Peace of the
county wherein the offence was committed,
shall be fined not less than fifty nor more than
two hundred dollars, or imprisoned in the
House of Correction for not less than three
months nor more than three years, in the dis-
cretion of the Justice trying the same.

SEC. 15. And be it enacted, That it shall be
unlawful for any person or persons to take or
catch oysters on Sunday or at night, and any
person or persons violating this section, shall,

ilar instrument; each figure shall be twenty-
two inches in length and of proportionate
