HENRY LLOYD, ESQUIRE, GOVERNOR.

lives, limbs or property of the citizens; and
when it shall appear that the offender is in-
toxicated so as to render it unsafe to permit
him to drive through the streets, shall provide
for the removal of the horse and vehicle with-
out the limits of the town, or for the deposit
thereof in some place of safety until the of-
fender shall be sober, and to subject the prop-
erty so taken and deposited to payment of the
costs of the proceedings and of the keeping of
said property until the same be released ac-
cording to law.

SEC. 15. And be it enacted, That the said Com-
missioners, or a majority of them, shall have
full power and authority annually, to appoint

a Constable, whose duty it shall be to preserve
the pea.ce and good order of said town, and
for this purpose he is hereby vested with the
same power and authority as any Constable
may now have under the laws of this State,
and shall receive such compensation for his
services as the said Commissioners deem just;
and the said Commissioners, or a majority of
them, may, when they deem it necessary, ap-
point ad ditional Constables with like authority,
at the discretion of said Commissioners.

SEC. 16. And be it enacted, That the Com-
missioners of said town shall have the power
to levy and collect taxes in said town, not ex-
ceeding in any one year one hundred cents on
one hundred dollars on the assessable property .
of said town; and they shall once in five years,
or oftener, if they think proper, cause a new
assessment of the real and personal property
within the limits of the town, and for that
purpose shall appoint one of the qualified
voters of said town being a freeholder therein,

ceeding in the execution of his duties, shall
take the oath of office herein prescribed; he
shall take as a, basis of said assessment the
market value of paid property, according to
his best skill and judgment, and the said
