the justice of the peace may proceed to hear the said


charge, so far as it applies to the said vessel, without


such appearance, and if the charge appear to be true


the vessel shall be forfeited, and the said justice shall


so enter upon his docket, and shall order the same to


be sold as hereinbefore provided, but the owner, mas-


ter, or any one havring a mortgage or other lien on


said vessel, may appeal from the said judgment entry


and order to the circuit court for Somerset county ;


upon his giving bond in such sum as may represent


double the value of the said vessel, the said vessel

of said county to appoint such deputies as may be nec-


essary to enforce the provisions of this sub-title in all


parts of said county, and he may obtain and employ


any such vessel as may be necessary to enable them to


enforce the same with effect and convenience, with


the approbation of the said county commissioners, who


shall pay for the same, and shall allow the said sheriff


or his deputies such compensation for their special


services as they may deem just and advisable, so as to


promote the observance of the provisions of this sub-


title; and the said county commissioners shall have

scattering the same upon the bottom of any oyster-


bearing grounds of said county so to replenish the


same for the use of the people of said county entitled


or licensed to use the same; and in case the general


assembly shall provide for the sale or lease of oyster


grounds for the propagation of oysters, the said county


commissioners may buy or lease the said waters of said


county for the use of the people thereof as aforesaid.


97. The money received from license for vessels of


ten tons and under shall be paid by the clerk to the


secretary and treasurer of the school board for Somer-
