proximately Five Thousand Dollars ($5, 000. 00) less than
the total amount so withheld, which said Five Thousand
Dollars ($5, 000. 00) should constitute a trust fund for the
benefit of the unpaid creditors hereinbefore set forth, but
which amount has not been paid over to said unpaid
creditors because said Board of Governors has no specific
power or authority given to make such payments by the
General Assembly of Maryland in its creation of said
Board, and

WHEREAS, All of said creditors still remain unpaid de-
spite the fact that they furnished the materials covered
by their bills in good faith and all of said materials were
used in the construction of said hospital building; there-
fore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Board of Governors of the Memorial
Hospital of Cumberland be, and it is hereby authorized,
whenever funds shall be available, to pay to the South
Cumberland Planing Mill Company, the sum of Four Hun-
dred Fourteen Dollars and Twenty-six Cents ($414. 26),
the Wilson Hardware Company, the sum of Two Hundred
Twelve Dollars and Three Cents ($212. 03), Merwin Mc-
Kaig, the sum of One Hundred Eight Dollars and Nine
Cents ($108. 09), the Cumberland Cement and Supply Com-
pany, the sum of One Thousand One Dollar and Twenty-
one Cents ($1, 001. 21), the Grant Lumber and Supply Com-
pany, the sum of Twenty-two Hundred Ninety-six Dollars
and Twenty-six Cents ($2, 296. 26), the Motor Transfer
Company, the sum of Two Hundred Ninety-nine Dollars
and Fifty Cents ($299. 50), and Brinker Brothers, the sum
of Nine Hundred Dollars' ($900. 00).

SEC. 2. And be it further enacted, That this Act shall
take effect from the first day of June, 1933.

AN ACT to add a new section to Article 5 of the Code of
Public General Laws of Maryland, Edition of 1924, en-
titled "Appeals and Errors, " the said new section to
