CHAPTER 446.
AN ACT to authorize and direct the County Commissioners
of Talbot County, to construct, own and operate, a canal
in Talbot County, connecting the head-waters of Oak
Creek, a tributary of Miles River, with the head-waters
of Plain Dealing Creek, a tributary of the Tred Avon
River, all in Talbot County.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the County Commissioners of Talbot
County, be and they are hereby authorized and directed to
construct, own and operate a canal in Talbot County, con-
necting the head-waters of Oak Creek with the head-waters
of Plain Dealing Creek, so as to connect the navigable
waters of the Miles River with the navigable waters of the
Tred Avon River.
SEC. 2. Be it enacted, That the County Commissioners
of Talbot County shall have power to determine the width,
the depth and the course of said canal, provided they be
in conformity with the regulations of the War Department
of the United States Government, and also to contract for
and acquire the right-of-way over and through the lands
where the canal may run. If, however, the necessary land
cannot be acquired by amicable agreements, then the same
shall be condemned in the manner as is now or may here-
after be provided for, the condemnation of land for public
roads and the County Commissioners shall have the same
powers and rights in regard to the construction, operation
and maintenance of said canal, that they, by law, now have
or may hereafter have over the County roads.
SEC. 3. Be it enacted, That all costs for digging of the
canal, the obtaining of rights-of-way by amicable agree-
ment or by condemnation proceedings, shall be raised by
private subscriptions, unless, such costs and expenses shall
be provided for by the Congress of the United States, it
being expressly hereby intended that the Taxpayers of Tal-
bot County shall in no wise be responsible for said costs
and expenses.
SEC. 4. And be it enacted, That this Act take effect the
first day of June, A. D. 1933.
