15. The State, and any municipal or other corporation,
commission, board, body or person, which under the laws
of this State, has a right to acquire property by condem-
nation, shall acquire such property, if condemnation pro-
ceedings be resorted to, in pursuance of, and under the
provisions of this Article, anything in any other Public
General Law or Public Local Law or private or special
statute to the contrary notwithstanding; provided, how-
ever, that nothing in this Article contained shall apply to
or change the present law or procedure for the opening,
closing, widening, or straightening of highways, except
that the State Roads Commission may, at its discretion,
acquire property by condemnation under the provisions of

this Article.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1933.

CHAPTER 342.

AN ACT to repeal and re-enact, with amendments, Section
5 of Article 93 of the Annotated Code of Public General
Laws of Maryland, Edition of 1924, entitled "Testa-
mentary Law, " sub-title "Account, " changing the order
of priority in the making of disbursements by the ad-
ministrator.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 5 of Article 93 of the Annotated
Code of Public General Laws of Maryland, Edition of
1924, entitled "Testamentary Law, " sub-title "Account, "
be, and the same is hereby repealed and re-enacted, with
amendments, so as to read as follows:

5. On the other side shall be stated the disbursements
by him made, and which are to be made in the following
order and priority: First, funeral expenses, to be allowed
at the discretion of the court according to the condition
and circumstances of the deceased, not to exceed three hun-
dred dollars ($300. 00) except by special order of the Court,
and provided the estate of the decedent be solvent; second,
his allowance for costs and extraordinary expenses (not
