obtained from the County Commissioners; and provided
further, that no such permit shall be issued unless the ap-
plication therefor contains a notation of the time and place
of such celebration and place of storage of such fireworks,
and the County Commissioners are satisfied that the public
safety will not be jeopardized.

SEC. 2. And be it further enacted, That nothing in the
provisions of this Act shall be construed as prohibiting the
sale, possession, or use of the following described fire-
works: Sparklers, torches, bos fire, fountains, dip sticks,
nonpoisonous snakes, colored lights, toy pistols of the fric-
tion type, and toy pistols of the automatic type.

SEC. 3. And be it further enacted, That any person
violating any of the provisions of this Act or of permits
issued thereunder shall, upon conviction thereof, be fined
not less than $1. 00 nor more than $40. 00 for each offense.

SEC. 4. And be it further enacted, That the Chief of
Police of Montgomery County shall confiscate and destroy
all stocks of fireworks or other explosives exposed for sale,
or held in stock in violation of any of the provisions of
this Act.

SEC. 5. And be it further enacted, That all Acts and
all ordinances, in municipalities or subdivisions, inconsis-
tent with the provisions of this Act, are hereby repealed to
the extent of such inconsistencies,

SEC. 6. And be it further enacted, That this Act shall
take effect June 1, 1933.
