whatever, a majority of those declared duly elected
as above, may fill all said vacancies.

Sec. 6. And be it enacted, That upon every share
of stock thus subscribed, there shall be paid to
such person or persons as may be appointed to se-
cure the same, the sum of five dollars, the balance
at such times as the President and Directors shall
require, and should any subscriber fail or neglect
to pay the same for the space of thirty days, next
after the same shall be due and payable, the stock,
on which it is demanded, shall be forfeited to the
company.

Shares — how

Sec. 7. And be it enacted, That the said company
is hereby declared to possess full power to locate
and construct a Passenger Railway or Gravel Road,
not to exceed sixty-six feet wide, from some conve-
nient point within the limits of the city of Balti-
more, to be selected by them, to a point on the Pa-
tapsco river in Baltimore county, and that in locat-
ing said road, as is hereby provided for, the Presi-
dent and Directors may enter upon any land neces-
sary for laying out, locating or making said road,
and may procure gravel, earth, wood, timber for
such use and obtain the right to the same as here-
inafter provided.

Sec. 8. And be it enacted, That the President and
Directors of said company may agree with the own-
er or owners of any lands, earth, gravel, timber or
other materials necessary for the construction or re-
pair of said road or its works, for the purchase or

cannot agree, or if the owner or owners be a feme
covert, non compos mentis, or out the State, on ap-
plication to a Justice of the Peace of Baltimore
county, he shall issue his warrant under his hand
and sea! directed to the Sheriff of Baltimore county,
requiring him to summon a jury of twelve men, in-
habitants of said county, not related to or anywise
interested in the premises, to meet on the land to.
be valued on a day to be specified in said warrant
not less than five nor more than ten days after is-
suing the same, and in case any of the jurors afore-
said do riot attend, he shall, instanter, summon as
many jurors as may be necessary, with the jurors in
attendance, to finish a panel of twelve jurors, who
shall act in the premises, and the Sheriff shall ad-
