said company shall also be liable for all damages
which shall be sustained by any person by reason
of such neglect.

Damages.

Sec. 23. And be it enacted, That if any person
or persons shall wilfully obstruct, injure, impair
or destroy any part of said railroad, or any of the
works, buildings, carriages, vehicles, engines or
machines of said company, he, she or they, for
every such offence shall forfeit and pay to the said
company three times the actual damages so sus-
tained, to he sued for and recovered, with costs of
suit, before any justice of the peace, or in any
court having cognizance of such matters, by action
of debt on the case, in the name and for the use
of the said company, and shall also be liable to in-
dictment in the proper court, according to the na-
ture of the offence.

Sec. 24. And be it enacted, That the President
and Directors of the said company are hereby au-
thorized and empowered to form an union with
such company or companies as are or may be incor-
porated in the State of Delaware, for the purpose
of constructing a railroad in said State to unite
with the railroad provided for in this act, so that
the capital stock of the said companies respectively
shall constitute a common stock, and the respec-
tive companies shall constitute one company, and
be entitled to all the rights, privileges and immu-
nities which each of them possess, have and enjoy,
under and by virtue of their respective charters;

ance and transportation of passengers or freight,
or with any individual whatsoever; provided, such
contract be not prohibited by the laws of Delaware
or Maryland.

wharves, houses and shops for corporate purposes;
to purchase and own steamboats to ply in connec-
tion with the said railroad to any place or places
whatever; and to contract with the owner or owners
of any steamboat, and any other railroad or other
company, for transportation, and passengers to
and from the said road, and when the final survey
of any part of the said railroad shall have been
made by the engineer of the said company, such
