case and this, being, that the one already passed upon was a
Senate bill, whilst the one now under consideration origina-
ted in this House.
I have no difficulty in reconciling the two Rules referred
to, and unhesitatingly state, that had I been presiding on the
occasion when the Speaker pro tem, was in the Chair, my de-
cision would have been different from the one rendered by
him; my opinion being very decided, that, under the twenty-
first Rule of this House, no further action can be had on a
question that has been indefinitely postponed, and that the
provisions of the twenty-ninth Rule of this body do not affect
a motion to postpone indefinitely any more than tbey do a
motion to reconsider a vote on the passage of a vetoed bill, a
vote, which it is universally conceded, cannot be reconsidered.
Were the question presented to me, de novo, I would there-
fore rule that the point of order was well taken.
I cannot, however, but regard the action of the Speaker
pro tem., as binding upon me, and conclusive of the question
raised. He having decided that under the Rules referred to
a motion to reconsider a vote indefinitely postponing a bill
was in order, and no appeal having been taken from that de-
cision, the decision of the Chair became the decision of the
House. The House, therefore, by acquiescing in the decision
of the Speaker pro tem., gave a construction to the twenty-
first and twenty-ninth Rules, from which I do not feel at lib-
erty to depart. I therefore rule that the point raised is not
well taken, and that the motion to reconsider the vote just
taken is properly before the House.
Mr. Hoblitzell appealed from the decision of the Chair.
The question then being,
"Shall the decision of the Chair stand as the judgment of
the House?"
