So the motion submitted by Mr. Vandiver was sustained,
and the motion to reconsider was laid on the table.
Mr. Neal, Chairman of the Committee on Elections, rising
to a question of privilege, submitted the following
REPORT:
WHEREAS, It has come to the knowledge of this House that
the attorneys conducting the election contest in the first legis-
lative district for Baltimore city, on behalf of the parties
claiming to be contestants, have addressed to the Committee
on Elections a most insulting note, in which they seek to ex-
cuse themselves for not appearing in person before the Com-
mittee, and using the following language : .
"The undersigned decline to submit any oral argument in
support of the claims of said contestants, for the reason that
they feel satisfied that the majority of your Committee have
already formed as well as expressed their opinions as to the
merits of the case, and they believe no oral argument based
op. the facts or the law would have any effect in influencing
the minds or judgment of said majority ;" therefore,
Resolved, That it is the sense of this House, that so much
of said communication is dearly a gross breach of profession-
al privilege on the part of these members of the legal profes-
sion, and that the above mentioned document shall not have
