distance nor shall this section apply to the issuance of a license
for a place of business established for the sale of alcoholic
beverage prior to June 1, 1939. Provided, however, that this
Section shall not apply to Class LP, Off Sale, Package Goods,
license.
43. BALTIMORE COUNTY. In Baltimore County, the
Board of License Commissioners shall not approve any license
to sell alcoholic beverages within one and one-half miles from
the corner of 4th and D Streets in Sparrows Point.
44. DORCHESTER COUNTY, (a) HURLOCK. Within the
corporate limits of the City of Hurlock, no new license shall be
granted to sell any alcoholic beverage on any premises located
within three hundred feet of a church or public school.
45. GARRETT COUNTY. No license shall be issued in
Garrett County if the applicant (1) has a Federal Permit for
the sale of any alcoholic beverages other than beer and if
such a permit is obtained subsequent to the issuance of the
license, then the license shall be automatically revoked and the
licensee shall be liable to prosecution for sale without a license;
(2) has a pool room or bowling alley, or place connected there-
with; (3) has not had an established business for one year
prior to the date of application.
APPLICATION FOR LICENSE
46. WHERE TO BE FILED, (a) Every application for a
manufacturer's or for a wholesaler's license, or for any form of
a Class E (On Sale—Steamboats) or of a Class F (On Sale—
Railroads) license shall be filed with the Comptroller. Every
application for any of the other licenses herein provided for
places of business to be operated in Baltimore City, shall be
filed with the Board of License Commissioners for Baltimore
City, and all applications for any such other license in the
counties, where authorized, shall be filed with the Board of
License Commissioners, if any, or the Clerk of the Circuit
Court of the County in which the place of business is to be
located, if there be no such Board.
(b) Whenever the place of business sought to be licensed
lies in more than one county, or in the City of Baltimore and a
county, it shall be deemed to be wholly within the county
or the City of Baltimore where the major portion lies; and all
alcoholic beverage laws of that place shall govern the licensing,
regulation and operation of the entire place of business.
