CHAPTER 342.
(House Bill 249)
AN ACT to authorize and direct the County Commissioners
of Baltimore County to acquire by purchase or condemna-
tion the Bear Creek Bridge, together with all approaches
and appurtenant structures and to authorize said County
to borrow a sum not exceeding $750,000 and to issue revenue
bonds therefor to carry out such powers and to provide for
the payment of the principal and interest of such bonds
from the tolls derived from said bridge and to pledge the
net receipts from said tolls to the payment of such principal
and interest, but in no event to pledge the full faith and
credit of the County to said payment.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the County Commissioners of Baltimore County be
and it is hereby authorized to exercise the powers conferred on
them by Section 77 of Article 89B of the Annotated Code of
Maryland (1939 Edition), to acquire by purchase or condemna-
tion all the right, title and interest in and to the Bear Creek
Bridge, together with all approaches and appurtenant struc-
tures, authorized to be built under Section 74 of said Article.
In exercising such powers the said County Commissioners shall
first attempt to purchase such bridge, approaches and appurte-
nant strcutures, but if in the opinion of the County Commis-
sioners a fair and reasonable price cannot be agreed upon by
said County Commissioners and the owner or owners of the
said bridge, the County Commissioners shall forthwith proceed
to exercise their said power of condemnation. The power and
authority conferred upon said County by Section 77 of said
Article 89B is hereby ratified and confirmed, but if for any
reason the powers of condemnation conferred upon the County
by said Article cannot legally be exercised, said County may
nevertheless acquire said bridge by condemnation pursuant to
the provisions of Article 33A of the Code of Public General
Laws of Maryland (1939 Edtiion).
SEC. 2. And be it further enacted, That said County Com-
