Charter (1938 Edition), title "Baltimore City", sub-title
"Powers", as said section was amended by Chapter 548 of
the Acts of 1945; and to repeal and re-enact, with amend-
ments, Section 868 of said Article 4 of the Code of Public
Local Laws of Maryland and Baltimore City Charter (1938
Edition), title "Baltimore City", sub-title "Police", as said
section was amended by Chapter 830 of the Acts of 1943,
to authorize the qualified voters of Baltimore City to
determine whether or not the power of appointment of the
Police Commissioner of the City of Baltimore shall be
transferred from the Governor to the Mayor of Baltimore
City and whether the Mayor and City Council of Baltimore
City shall be authorized to establish and maintain a Police
Department, within and subject to the limitations pre-
scribed by said Section 6 of Article 4 of the Code of Public
Local Laws and Baltimore City Charter, as hereby amended.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 868 of Article 4 of the Code of Public Local
Laws of Maryland and Baltimore City Charter (1938 Edition),
title "Baltimore City", sub-title "Police Commissioner", be
and it is hereby repealed and re-enacted, with amendments, to
read as follows:

868. There shall be appointed by the Mayor in the
manner prescribed in Section 12 of this Charter on June
1, 1949 and every six years thereafter, one discreet per-
son, resident or engaged in business in the City of Baltimore
for three consecutive years next preceding the day of his ap-
pointment, who shall be known as the Police Commissioner
for the City of Baltimore, and whose term of office shall con-
tinue for six years and until his successor is appointed and
qualified. If a person appointed Police Commissioner is a
member of a Retirement or Pension System of the State of
Maryland or City of Baltimore, he shall have the right to con-
tinue as a member of such system, with all the rights, privi-
leges and benefits which the members of such system may have
as to retirement on pension or the payment of pension or other
benefits to his widow or other beneficiary, provided he con-
tinues to pay the same amount of contribution to such retire-
ment system or pension fund which he was paying when he
became Police Commissioner. Upon ceasing to be Police Com-
missioner, such person shall have the right to be retired on
pension, with all the rights and privileges of the system of
which he is a member, without any regard to the age require-
ments or the requirements for physical examination required
by such system, provided the total combined service prior to
becoming Police Commissioner and as Police Commissioner
