spectively; provided, that no such claim shall be enforced
against any real estate of a recipient while it is occupied by
the recipient's surviving spouse or dependents.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1947.

CHAPTER 700.
(House Bill 49)
AN ACT to repeal and re-enact, with amendments, Sections
2, 3, 4, 9, 16, 17, 19 and 21 fa Article 70A of the Annotated
Code of Maryland (1939 Edition and 1943 Supplement), title
"Old Age Assistance'", and to repeal Section 10 of Article
70A of the Annotated Code of Maryland (1939 Edition), title
"Old Age Assistance"; to clarify the provisions of said
sections, to provide for the abolition of certain requirements
contained in said sections in the event of certain future
Federal legislation, to increase the payments which may be
awarded under said Article, to repeal the section relating
to the assignment of property by applicants for assistance,
and revising said sections generally.
SECTION 1. Be it enacted ly the General Assembly of Mary-
land, That Sections 2, 3, 4, 9, 16, 17, 19 and 21 of Article
70A of the Annotated Code of Maryland (1939 Edition and
1943 Supplement), title "Old Age Assistance", be and they
are hereby repealed and re-enacted, with amendments, to
read as follows:
2. (Definitions.) As used in this Article, "State Depart-
ment" means the State Department of Public Welfare cre-
ated under Article 88A of the Annotated Code of Mary-
land and any amendments thereto or supplements thereof.
"County Department" means the County Welfare Board
of the respective counties in this State, created and exist-
ing under Article 88A of the Annotated Code of Maryland,
and any amendments thereto or supplements thereof, and
includes the Department of Public Welfare of Baltimore
City as created and existing under Section 167 of the Charter
of Baltimore City, with the powers, limitations and restric-
tions imposed by Article 88A and any amendments thereto
or supplements thereof.
