Dollars ($500.00) and costs of prosecution, or by imprison-
ment not to exceed ninety (90) days, or both such fine
and imprisonment in the discretion of the court. Each
day, upon which a violation of the provisions of this sub-title
shall occur, may be deemed a separate and additional viola-
tion for the purpose of this sub-title. It shall be the duty
of the Attorney General of the State of Maryland to take
charge of and prosecute all cases arising under the provisions
of this sub-title, including the recovery of penalties.
36. Nothing in this sub-title shall be construed to alter,
change, modify or restrict the jurisdiction of the State Board
of Health of Maryland as set forth in Article 43 and the
amendments thereto of the Annotated Code of Public General
Laws of Maryland.
37. The Washington Suburban Sanitary Commission shall
not be required under this sub-title to spend more than Two
Hundred Fifty Thousand Dollars ($250,000) in any calendar
year for the elimination or control of "Pollution".
SEC. 2. Be it further enacted, That should any sections,
part or parts of this Act be declared invalid or held to be
unconstitutional by any court of competent juridiction, the
same shall not affect the validity of the Act as a whole or
any part or parts thereof, other than that portion so held
to be invalid.
SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1947.

(House Bill 46)
AN ACT to repeal and re-enact, with amendments, Sections
3B, 12 and 13 of Article 88A of the Annotated Code of Mary-
land (1943 Supplement), title "State Department of Public
Welfare", sub-title "Board of Welfare", relating to the pay-
ment of fees to attorneys and expenses of members of County
Welfare Boards incurred in attending meetings, providing
for the resignation of County Welfare Board members
under certain conditions, eliminating certain obsolete pro-
visions and clarifying the provisions of said sections.
