of Natural Resources", said new sections to be known as
Sections 28 to 37, inclusive, to follow immediately after
Section 27 of said Article and to be under new sub-title
''Water Pollution Control Commission", relating to the
control of pollution of the surface and underground waters
of the State; creating the Maryland Water Pollution Con-
trol Commission; and prescribing its powers and duties.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That ten new sections be and they are hereby added
to Article 19A of the Annotated Code of Public General
Laws of Maryland (1939 Edition and 1943 Supplement), title
"Conservation of Natural Resources" said new sections to be
known as Sections 28 to 37, inclusive, to follow immediately
after Section 27 of said Article, to be under the new sub-title
"Water Pollution Control Commission" and to read as fol-
lows:

WATER POLLUTION CONTROL COMMISSION.

28. The term "Pollution" shall mean the discharge or de-
posit into any of the waters of the State of any liquid or
solid substance or substances which may create a nuisance
therein or render such waters unclean or noxious so as to
be detrimental to the propagation, cultivation or conservation
of animals, fish or aquatic life, or unsuitable with reasonable
treatment, for use as present or possible future source of
public water supply or unsuitable for commercial, industrial,
agricultural, recreational or other reasonable uses. The term
"Waters of the State" shall include both surface and under-
ground waters within the boundaries of this State or subject
to its jurisdiction including that portion of the Atlantic
Ocean and its tributaries within the State of Maryland, the
Chesapeake Bay and its estuaries and all ponds, lakes, rivers,
and streams. The term "Person" shall be construed to in-
clude the State, any municipality, county, public or private
corporation, co-partnership, firm or any other entity what-
soever.

29. There is hereby created a Maryland Water Pollution
Control Commission, hereinafter referred to as the "Commis-
sion", which shall be composed of seven members, citizens and
residents of the State as follows: The Director of the State
Department of Health, the Chairman of the Board of Natural
Resources, the State Game Warden, the Director of the De-
partment of Research and Education and three members to be
appointed by the Governor. The Governor shall designate one
member among the appointed members to serve as Chairman
or the Commission. The term of each appointed member shall
