Maryland (1939 Edition), title "State Planning Commission",
be and it is hereby repealed and re-enacted, with amendments,
to read as follows:
1. The State Planning Commission is hereby created.
The Commission shall consist of nine (9) members who shall
be selected as follows: one shall be a member of the State
Roads Commission or the Chief Engineer of the Commission,
whichever shall be designated by the Governor; one shall
be a member of the State Board of Health or the Director
of Health, whichever shall be designated by the Governor;
one shall be a member of the State Board of Public Welfare
or the Director of Public Welfare, whichever shall be desig-
nated by the Governor, each of the persons so designated by
the Governor shall be appointed for a term of four years,
which shall begin upon the date of appointment and shall
terminate on June 1st, 1951, and thereafter shall be appointed
for terms of four years; the Chairman of the Legislative Coun-
cil and the Chief Engineer of the State of Maryland shall
be ex-officio members of the Commission; the other four
members of the Commission shall be appointed by the Gov-
ernor who shall make such appointments, so that one member
shall be from Western Maryland, one from Southern Mary-
land, one from Central Maryland (including Baltimore City)
and one from the Eastern Shore, which last four members
shall be appointed in such manner that the term of one of
such members shall be one year, one shall be for a term of
two years, one shall be for a term of three years and one for
a term of four years, all of whose terms shall begin June 1,
1947, and thereafter their successors shall be appointed for
four-year terms. In case of a vacancy, the Governor shall
make an appointment for the unexpired term in accordance
with the above provisions.
All members shall serve without compensation but shall
be allowed any reasonable expenses incurred in the per-
formance of their duties under this Article. The Governor
shall designate the Chairman of the Commission. The Com-
mission shall maintain offices which may be located in an
office of an existing State Department. Five members shall
constitute a quorum and no action shall be taken or rejected
without the concurring vote of a majority of the members
present. The Commission shall keep permanent and com-
plete records of its proceedings, meetings, hearings and de-
cisions. The Commission is hereby authorized to appoint
and employ such persons as may be required for the perform-
ance of its powers and may incur any other necessary ex-
penses within the limits of such funds as may be provided
therefor.
