On motion by Mr. Sulivane,

House bill entitled on Act to repeal Section 1, of the Acts
passed January Session, 1876, entitled an Act to protect fish
in the Black Water River, in Dorchester County, and to
enact the following in lieu thereof,

Was recommitted to the Select Committee.

House bill entitled an Act supplementary to an Act passed
at the January Session, 1876, entitled an Act to amend an
Act entitled an Act to incorporate the Methodist Episcopal
Church of Frederick, passed February 24th, 1841, Chapter
125,

Was read a third time and passed by yeas and nays as;

follows:

Ford, Peter,

NEGATIVE—None.

Said bill was then returned to the House of Delegates.

The President laid before the Senate the following opinion;
of the Circuit Court of Anne Arundel County.

That in ascertaining the balance in the Treasury on the
1st of October, 1877, to the credit of the School Tax, the
Comptroller ought not to charge that fund with the appro-
priations for the State Normal School, prior to the fiscal year
1868, nor with the expenses of the State Board of Education,
nor with appropriations to Colored Schools or the State Nor-
mal Colored School.

According to the proper construction of the laws of the
State relating to free Public Schools, it is the duty of the
Comptroller of the Treasury, on the 15th day of June, the
1st day October, the 1st day January and the 15th day of
March in each year, to apportion among the several Counties
and the City of Baltimore, according to the ratio prescribed;
by law, the whole amount of each school tax in the Treasury
on each of the clays of such appointment.
