1878.] OF THE SENATE. 679

conditions upon which alone this extension of time was
granted.

Unless the Legislature should see fit to revive the charter
of the Baltimore and Drum Point Railroad Company, it
would seem that its corporate life had wholly ceased.

Your Committee think that it is the duty of the Annapolis
and Elkridge Railroad Company to proceed by due course of
Law to ascertain the extent to which its mortgage bonds
Lave been misapplied.

They further think that it is the duty of that Company to
resist the right of any person or persons whatsoever, deriving
title under the Baltimore and Drum Point Railroad Com-
pany, to hold or vote any stock in the Annapolis and Elk-
ridge Railroad Company.

They further think that it is the duty of the State as a
stockholder in the Annapolis and Elkridge Railroad Com-
pany, to protect its interest by taking such proceedings as will
ascertain the true amount of the indebtedness to which that
company is subject, under a proper construction of the mort-
gage created under the Act of 1872, Chapter 425, and gener-

ally to take such measures as are needful to protect its inter-

ests in that company.

They consider that these objects can be best reached by
giving general instructions to the Attorney General of this
State. They submit therefore the following Joint Resolu-
tions for the consideration of your Honorable Body.

WM. T. HEPBRON,
EPH. G. POLK.
Which was read and adopted.

Said Committee also submitted the following
RESOLUTION.

whole subject of the relations existing between the Annapolis
and Elkridge Railroad Company and the State be referred to
the Attorney General; and that he be instructed to take such
action in the premises as he in the exercise of his discretion
may deem best calculated to promote the interests of the State.

Which was read the first time.
On motion by Mr. Miller,

Senate bill entitled an Act to amend Chapter 244, of the

Acts of 1872, entitled an Act to authorize the appointment

of Weighers of Grain by the Governor by repealing the 6th
