Mr. Dennis submitted the following amend ment to the

amendment:

AMENDMENT PROPOSED.

Strike out all after Section 1, and insert:

Section 1. Be it enacted 'by the General Assembly of Mary-
land, That all the franchises and property, of every descrip-
tion, and gross receipts of the Baltimore and Ohio Railroad
Company, within the State of Maryland, shall be liable to
assessment and subject to taxation, for State, County and
municipal purposes, according to the laws of this State, in-
cluding its Metropolitan Branch Railroad, and of its entire
Washington Branch Railroad, and from all other sources
within this State, in consideration of the release of its obli-
gation to pay to the State the one-fifth of its gross receipts
for the transportation of passengers over the Washington
Branch of its road, as now provided by law.

Section 2. And be it enacted, That the Baltimore and Ohio
Railroad Company be, and is hereby released and discharged
from all claim, debt or demand whatsoever, which the State
has againt the said Company, to the end of the month of
December, in the year eighteen hundred and seventy-seven,
provided the said Baltimore and Ohio Railroad Company
release, acquit and discharge the said State from all claims
or demand whatsoever the said Company may have against
the said State ; and provided further that the said Baltimore
and Ohio Railroad Company shall pay to the said State the
sum of four hundred and fifty thousand dollars, the said sum
to be paid in —— equal annual instalments, with interest
on each instalment from the first day of January, eighteen
hundred and seventy-eight, and the said sum when paid in
full with interest, shall be a full payment and discharge of all
judgments in favor of the State against said Company, and of
all claims and demands of this State against said Company.

Pending the consideration of said amendment,

Mr. Sulivane moved that the amendment submitted by Mr.
Dennis be printed, and that said bill and amendment be
made the order of the day for Monday the 18th instant,

Pending the consideration of which motion,
On motion by Mr. McLane,

At 3,25, P. M, the Senate took a recess until 5 P. M.,
by yeas and nays as follows :
