NIGHT SESSION.

WEDNESDAY, March 30th, 1904.
The House resumed business at 10 o'clock, p. m.
Present at the call of the roll 94 members :

UNFINISHED BUSINESS.

The house took up the further consideration of the
report of the Committee on Elections in the contested
election cases in Charles county.

RESOLUTION.

Whereas the elections committee of the House of
Delegates having determined that James de B. Wal-
bach being duly returned election is found eligible
and Hungerford Smoot while returned elected is found
to be ineligible.

Resolved therefore, that James de B. Walbach be
and he is hereby determined to be a member of this
body and entitled to his seat and Hungerford Smoot
being ineligible is not entitled to a seat in this body
and is hereby determined not to be a member hereof.

Which was rejected by yeas and nays as follows :
